《八十七年》内容简介

　　现今的知识界肩负着重新认识美国的任务。在这样一个庞大而艰巨的任务中，对美国宪制的研究在长时间内承担着不可承受的重负，被赋予了太多学术之外的意义和意图。要走出这样的迷思，一方面要坚持以扎实的研究作为学术讨论的基础，另一方面也要继续挖掘具有自身主体性的美国宪法研究，既不能将自身“变成法律的一部分”，更不能让自己成为“美国法的一部分”。在这一意义上，此书是一种真正展开中国学者自身主体性的美国宪法研究，通过美国宪法史上的一段“断代史”，以“建国”与“重建”作为所有讨论的两个焦点，向读者呈现了建国宪法如何历经三代人守护，真正成为联邦共同体所有人的法律，在一代又一代人中发挥着宪法的团结功能。

　　1776年美国建国，1863年林肯作为第16任总统发表葛底斯堡演说，这八十七年来的若干政治斗争和关于宪法的论辩，以及不同的政治人物在不同时期做出的不同努力，是本书的主要讨论对象。作者在历史的纵深中梳理制度形成的来龙去脉，实事求是地展示各种力量在历史重大关头的选择，并且不忽视历史行程中的偶然和复杂，组织起对美利坚的创制的讨论。

　　这是一部充分体现中国学者主体性、以中国的学术话语认真研究美国的专著，在基本立场上，作者摒弃了曾经影响过中国学术界的美国制宪的“民主奇迹”说，同时，通过历史路径来反思美国法治道路，有助于驱除我们曾经为美国模式编织的光环。

A brief introduction to Eighty-seven Years

Today's intelligentsia is tasked with a new understanding of America. In such a vast and arduous task, the study of the American constitution has for too long borne an unbearable burden, and has been given too much meaning and intent outside of scholarship. To get out of such a myth, on the one hand, we should insist on solid research as the basis of academic discussion, on the other hand, we should continue to explore the study of the US Constitution with its own subjectivity, and neither can we "become a part of the law", let alone make ourselves "a part of American law". In this sense, this book is a real study of the U.S. Constitution that unfolds the subjectivity of Chinese scholars themselves. Through a period of "history" in the history of the U.S. Constitution, with "founding" and "reconstruction" as the two focal points of all discussions, it shows readers how the founding Constitution has been protected by three generations and truly become the law of the owners of the federal community. For generations, the Constitution has served its unifying function.

From the founding of the United States in 1776 to Lincoln's Gettysburg Address as the 16th president in 1863, the eighty-seven years of political struggles and debates over the Constitution, as well as the different efforts made by different political figures at different times, are the main subjects of this book. In the depth of history, the author sorts out the ins and outs of the formation of the system, realistically shows the choices of various forces at major historical moments, and does not ignore the accident and complexity of the historical journey, and organizes the discussion of the creation of the United States.

This is a monograph that fully reflects the subjectivity of Chinese scholars and carefully studies the United States with Chinese academic discourse. From a basic standpoint, the author abandons the "democratic miracle" of the American Constitution that has influenced Chinese academia. At the same time, reflecting on the path of the rule of law in the United States through the historical path helps to drive away the halo that we once weaves for the American model.

About the author

Tian Lei, Professor of Law, East China Normal University. His research focuses on constitutional change in the course of history, and his recent books are "When Spring Happens: The Birth and Construction of China's '82 Constitutional System' (1979-1992)" (2022), "Following the Past as the Preface: The Institutional Development of China's Constitution" (2021), translated into "We the People: Transformation" and "Tangled in Our Own Cocoon: Deep History of the Early Human State".
